Successful Defence on a Mareva Injunction

Mathews Samac LLP was retained to represent an individual and corporate defendant condominium developer after they were made subject to an ex parte Mareva Order obtained by investors in a Niagara region development project.

The Mareva Order and allegations were challenged in Court by counsel at Mathews Samac LLP.  While counsel were advancing defences in Court, counsel for both sides worked to negotiate a settlement agreement between the parties.

Following extensive dialogue, a favourable settlement was reached for the clients, resulting in the withdrawal of both the action and the injunctions and restraints against them.
